A Policy Statement on Out of State Disciplinary Action

Approved by the Board on February 1, 2007

This policy statement is not a legally binding opinion of the Board, but is only intended to provide guidance to the public. The Board may make formal policy only through administrative rules, declaratory orders or contested case decisions.

The Iowa Board of Medical Examiners may choose not to file formal disciplinary action in out-of-state disciplinary cases because there is not an immediate threat to the public when the physician does not have an active Iowa medical license, has not recently resided and/or practiced in Iowa, and the action taken by the other medical board is public record. However, the Board reserves the right to file formal charges in the future if the physician returns to practice medicine in Iowa. The Board also reserves the right to file formal charges in such cases if it concludes that the physician has engaged in serious misconduct and/or there appears to be potential harm to the public.
